General conditions of Sale

General Provisions
These conditions are valid exclusively between the company DODAROSHOP with registered office in Via Pianette, 76/78 - 87046 Montalto Uffugo (CS), VAT No. IT02304240787, and any person who makes online purchases on the website www.dodaroshop.it hereinafter referred to as "CUSTOMER". These conditions may be subject to change, and the date of their publication on the website shall be equivalent to the date of their entry into force.
These terms and conditions govern purchases made on the www.dodaroshop.it website, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014 and Legislative Decree no. 70/2003 on e-commerce.

ARTICLE 1 - Object of the contract
With these general terms and conditions of sale, DODAROSHOP sells and the CUSTOMER purchases at a distance the tangible movable goods indicated and offered for sale on the website www.dodaroshop.it. The contract is concluded exclusively via the Internet, by means of the CUSTOMER accessing www.dodaroshop.it and placing a purchase order according to the procedure set out on the website itself.
The CUSTOMER undertakes to read these general terms and conditions of sale, in particular the pre-contractual information provided by DODAROSHOP, before confirming his or her order, and to accept them by placing a flag in the box indicated.

ARTICLE 2 - Pre-contractual information for the consumer - Article 49 of Legislative Decree 206/2005
Prior to the conclusion of the purchase contract, the CUSTOMER is informed of the characteristics of the goods that are illustrated in the individual product sheets at the time of selection.
Prior to the conclusion of the purchase contract and before the validation of the order with obligation to pay, the CUSTOMER is informed about
- total price of the goods including taxes, with details of shipping costs and any other costs;
- method of payment;
- the deadline by which DODAROSHOP undertakes to deliver the goods;
- the conditions, terms and procedures for exercising the right of withdrawal (Article 6 of these conditions) as well as the standard withdrawal form in Annex I, part B of Legislative Decree 21/2014;
- information that the CUSTOMER will have to bear the cost of returning the goods in case of withdrawal;
- existence of the legal guarantee of conformity for the purchased goods;
- conditions of after-sales assistance and commercial guarantees provided by DODAROSHOP.
The CUSTOMER may at any time, and in any case before the conclusion of the contract, become acquainted with the information relating to DODAROSHOP, the geographical address, telephone number, e-mail address, information which is also set out below:

ARTICLE 3 - Conclusion and effectiveness of the contract
The contract of sale is considered concluded with the sending by DODAROSHOP to the CUSTOMER of an e-mail confirming the order, with which the CUSTOMER contextually accepts the general terms and conditions governing the sale.
The e-mail contains the CUSTOMER's data, the order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent.
The execution of orders is conditional on full payment of the price by the CUSTOMER no later than 5 working days from receipt of the order as well as the availability of the products in stock. Consequently, the non-payment of the price or the lack of availability of the products in stock will result in the automatic termination of the contract communicated to the customer by e-mail, which will be followed by the return of any sums already paid by way of price.
The CUSTOMER undertakes to verify the correctness of the personal data contained therein and to promptly notify DODAROSHOP of any corrections.
DODAROSHOP strives to describe and present the items sold on the site in the best possible way. Nevertheless, there may be some errors, inaccuracies or small differences between the site and the actual product. Furthermore, the photographs of the products presented on www.dodaroshop.it do not constitute a contractual element, as they are only representative. However, the images and colours of the products offered for sale online may not correspond to the real ones as a result of any improvements and implementations made in the medium term or as a result of the particular Internet browser and monitor used.
DODAROSHOP undertakes to deliver the goods within 7 days from the sending by DODAROSHOP of the order confirmation e-mail to the CUSTOMER, except for delays not attributable to the seller but to the shipper/carrier.

ARTICLE 4 - Availability of products
Product availability refers to the actual availability at the time the CUSTOMER places the order. Such availability must in any case be considered purely indicative because, due to the simultaneous presence on the site of several users, the products may be sold to other CUSTOMERS before the order is confirmed.
Even after the order confirmation e-mail sent by DODAROSHOP, there may be cases of partial or total unavailability of the goods. In this eventuality, the order shall be automatically rectified with the deletion of the unavailable product and the CUSTOMER shall be immediately informed by e-mail.
If the CUSTOMER requests the cancellation of the order, terminating the contract, DODAROSHOP shall refund the amount paid within 14 days from the day on which DODAROSHOP became aware of the customer's decision to terminate the contract.

ARTICLE 5 - Methods of payment
All payments by the CUSTOMER may only be made using the credit cards indicated on the www.dodaroshop.it website, by bank transfer, directly in the shop or by cash on delivery with a surcharge of €3.00.
Payments may also be made using Gift Cards. Any transaction costs that are dependent on the instrument or payment method chosen by the customer shall be borne by the customer and cannot be claimed from the seller.

ARTICLE 6 - Prices
All sales prices of the products shown on the www.dodaroshop.it website are in Euros and include VAT, and where applicable, the WEEE contribution.
Shipping costs are not included in the purchase price, but are indicated and calculated at the conclusion of the purchase process before payment is made. In the event of visible damage to the packaging, the customer shall, at the time of delivery, check the product supplied in the presence of the courier and accept the withdrawal "with reserve" and immediately notify the seller. Otherwise, late notifications cannot be accepted.
The CUSTOMER accepts the right of DODAROSHOP to determine the prices at any time up to the time of the order, however the goods shall be invoiced on the basis of the prices indicated on the website at the time of order creation and indicated in the confirmation e-mail sent by DODAROSHOP to the CUSTOMER.
In the event of a computer error, manual, technical or any other nature that may result in a substantial change, not foreseen by DODAROSHOP, in the retail price, making it exorbitant or clearly derisory, the purchase order will be considered invalid and cancelled and the amount paid by the CUSTOMER will be refunded within 14 days from the day of cancellation.

ARTICLE 7 - Right of withdrawal
In accordance with the regulations in force, the CUSTOMER has the right to withdraw from the purchase without penalty and without specifying the reason, within the term of 14 days from the date of receipt of the products.
The CUSTOMER who intends to exercise the right of withdrawal must communicate it to DODAROSHOP by means of an explicit declaration, which must be sent by registered letter with return receipt or by email with reference to the order number and subject of the withdrawal email.
The CUSTOMER may also exercise the right of withdrawal by sending any explicit declaration containing the decision to withdraw from the contract, or alternatively by sending the standard withdrawal form, as set out in Annex I, part B, Legislative Decree 21/2014 (not mandatory), the text of which is set out below:

In the event of exercising the right of withdrawal, the CUSTOMER shall return the goods within 14 days from the day on which he/she communicated to DODAROSHOP his/her intention to withdraw from the contract pursuant to Article 57 of Legislative Decree 206/2005.
The goods shall be returned in their original packaging if possible, undamaged, complete in all its parts to:

The direct costs of returning products are the responsibility and expense of the CUSTOMER. Even used goods without original packaging with signs of use etc. can be returned by the consumer. However, in that case the seller may reserve the right to retain an amount equal to the reduced value of the goods as part of the refund.

Without prejudice to the right to verify compliance with the above, DODAROSHOP shall refund the amount of the products subject to withdrawal within a maximum period of 14 days, including any shipping costs.

As provided for in Article 56 paragraph 3 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, DODAROSHOP may suspend the refund until receipt of the goods or until the CUSTOMER proves that he has sent the goods back to DODAROSHOP. It is the customer's responsibility to prove that he has sent the goods back to DODAROSHOP.

DODAROSHOP shall make the refund using the same means of payment chosen by the CUSTOMER at the time of purchase. In case of payment made by bank transfer, and in case the CUSTOMER intends to exercise his right of withdrawal, he shall provide DODAROSHOP, by accessing the contact us section, with the bank details: IBAN, SWIFT and BIC necessary for DODAROSHOP to make the refund.

In the event of withdrawal for a purchase made with a gift card and loyalty voucher, the amount will be returned to the CUSTOMER with a purchase voucher identified with a promotional code that will be sent to the CUSTOMER'S e-mail address, or in the event of withdrawal exercised at a point of sale, the amount will be returned with a purchase voucher delivered to the CUSTOMER.
The purchase voucher shall be valid for 2 years and may be used by the CUSTOMER for subsequent purchases in a lump sum.


ARTICLE 8 - Legal guarantee of conformity
In the event that the CUSTOMER receives products that do not comply with orders or that are defective, the CUSTOMER has the right to have the conformity of the product restored free of charge by repairing or replacing the product, the seller having the right to verify that the use of the product complied with the use and maintenance manual. The CUSTOMER must send an e-mail to admin@dodaroshop.it with reference to the order number and reason for the return and enable the seller to verify the complaint. After the assessment, it will be agreed to collect the goods at the expense of DODAROSHOP: the latter reserves the right to request the reimbursement of all shipping costs, in addition to the greater damage, in the event of tampering or improper use of the goods by the purchaser. The CUSTOMER may exercise this right if the defect becomes apparent within two years of delivery of the goods and reports the defect to DODAROSHOP within two months of its discovery. The CUSTOMER shall not be entitled to such treatment if the product is damaged as a result of incorrect use by the same, or in the event of use that does not comply with the characteristics of the product, also with reference to its storage. Some products, if not correctly used, stored and maintained according to the use and maintenance manual with which they are equipped, could undergo obsolescence phenomena for which the seller shall not be liable, since the conformity of the product is altered by such improper behaviour. The purchaser within sixty days of receipt of the goods is obliged to notify by registered letter with return receipt or by pec (by pec) the lack of information regarding the use and maintenance of the product: in the absence of such notification by the purchaser, the seller may also contest in court that it has not been notified. A minor conformity defect for which it was not possible or excessively burdensome to pursue the remedies of repair or replacement does not entitle the seller to terminate the contract (Art. 130 para. 10 Consumer Code).

ARTICLE 9 - Commercial guarantee
All products presented on the www.dodaroshop.it website benefit, in addition to the legal guarantee of conformity referred to in the previous article, from a commercial guarantee whose duration is mentioned on the product sheets of the articles.
If an invoice is required, the customer may only request it at the same time as the order or before it is processed. After processing or dispatch, it will no longer be possible to request an invoice and a receipt will be sent to the customer.
In order to benefit from warranty service, the CUSTOMER may request the receipt/invoice issued during the order confirmation directly from DODAROSHOP at any time.

ARTICLE 10 - Methods of delivery
DODAROSHOP will only accept orders to be delivered in the Italian territory and in the Republic of San Marino. The products will be delivered by express courier to the address indicated by the CUSTOMER when placing the order within approximately 48-72 hours from the date of receipt by the CUSTOMER of the order confirmation e-mail sent by DODAROSHOP.

For each order placed on www.dodaroshop.it, DODAROSHOP shall issue a copy of the summary of the goods shipped. The invoice shall be requested with the appropriate flag and shall contain the information provided by the CUSTOMER during the purchase procedure. After the invoice has been issued, it shall not be possible to make any changes to the data indicated on the invoice.

ARTICLE 11 - Liability
DODAROSHOP assumes no liability for inefficiencies attributable to force majeure or fortuitous events, even if dependent on malfunctions and failures of the internet network, in the event that it is unable to execute the order within the time specified in the contract. DODAROSHOP assumes no liability for the use, storage, maintenance, non-compliant tampering of the goods sold, as better regulated in number 8 of these general conditions.

ARTICLE 12 - Access to the site
The CUSTOMER has the right to access the site for consultation and making purchases. No other use, particularly commercial, of the site or its content is permitted. The integrity of the elements of this site, whether audio or visual, and the related technology used remain the property of DODAROSHOP and are protected by intellectual property law.

ARTICLE 13 - Cookies
The www.dodaroshop.it website uses "cookies". Cookies are electronic files that record information relating to the navigation of the CUSTOMER on the website (pages consulted, date and time of consultation, etc..) and allow DODAROSHOP to offer a personalised service to its customers.
DODAROSHOP informs the Customer of the possibility of deactivating the creation of such files, by accessing its Internet configuration menu. It is understood that this will prevent the Customer from proceeding with the online purchase.

ARTICLE 14 - Entirety
These General Terms and Conditions of Sale are made up of the entirety of the clauses comprising them.

ARTICLE 15 - Alcoholic beverages
There are no offers targeting users who have not reached the age at which the consumption of alcohol is permitted. No claims are made about the benefits of alcohol consumption. The products in question shall only and exclusively be sold to customers of legal age, as provided for by Italian law.

ARTICLE 16 - Applicable Law and Jurisdiction
These General Terms and Conditions of Sale are subject to Italian law.
Any dispute that cannot be settled amicably shall be submitted to the exclusive jurisdiction of the Court of COSENZA. The European Commission provides an online platform for dispute resolution, available at the following link: https://ec.europa.eu/consumers/odr/.
